More than 35 years of experience in arbitration, mediation, litigation, contract negotiation, and claims consulting relating to domestic and international multi-million dollar public and private commercial and industrial construction projects up to $285 million.

Claims included:

  • defective design and construction, including structural, HVAC, electrical, mechanical, roofing, moisture intrusion, building envelope, concrete, paving, landscaping, and irrigation;
  • delay, disruption, acceleration, and lost productivity (involving analysis of critical path scheduling, home office overhead, extended job site overhead, general conditions, and liquidated damages);
  • excessive owner changes;
  • differing site conditions;
  • expansive soils;
  • variations-in-quantity;
  • payment disputes, including prompt payment acts, pay-if-paid and pay-when-paid clauses, backcharges, and pass-through claims;
  • incomplete and inaccurate owner-provided P&IDs;
  • government contracts, including the Contract Disputes Act, bid protests, and the Federal Acquisition Regulations;
  • surety payment and performance bonds; and
  • insurance coverage.

 

Projects included:

  • a concert hall and conference center in Reykjavik, Iceland;
  • a cofferdam for a power plant in Mexico;
  • a salt-to-bleach plant in Pennsylvania;
  • the Hoover Dam Visitors’ Center;
  • the parallel span of the Chesapeake Bay Bridge;
  • the runways and Terminal for Denver International Airport;
  • sediment removal in a Colorado reservoir;
  • luxury hotels in Vail, Colorado;
  • a refinery in Utah;
  • tactical ranges and an assault course at a military base in Colorado;
  • multiple road and bridge design and construction projects;
  • industrial hygiene/moisture mapping for hotel water damage remediation;
  • a residential development in Thornton, Colorado; and
  • negotiation and preparation of the design/build contract for Denver International Airport Terminal and Concourses.
